Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the MrFit365 application, website, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

Eligibility

You must be at least 16 years old to use MrFit365. By using the Service, you confirm that you meet this requirement and have the authority to accept these Terms.

Account Responsibilities

  • Provide accurate registration information and keep it current.
  • Maintain the confidentiality of your login credentials.
  • Notify MrFit365 immediately of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

Subscription and Billing

MrFit365 offers free and paid subscription tiers. Fees are billed in advance on a recurring basis and are nonrefundable except where required by law. You may cancel at any time; access to paid features continues through the end of your billing cycle.

Acceptable Use

You agree not to:

  • Reverse engineer, modify, or create derivative works of the Service.
  • Upload malicious code, automate access, or interfere with our infrastructure.
  • Share another person’s personal data without their consent.
  • Use MrFit365 in violation of applicable laws or regulations.

Health and Safety Disclaimer

MrFit365 provides training guidance but does not replace medical advice. Consult a qualified healthcare professional before starting any fitness program. By using the Service, you accept responsibility for your training decisions and outcomes.

Intellectual Property

MrFit365 and its licensors retain all rights, title, and interest in the Service, including software, content, branding, and technology. These Terms do not grant you ownership of any intellectual property.

Termination

We may suspend or terminate access if you violate these Terms. You may stop using MrFit365 at any time. Certain obligations, such as payment of outstanding fees, survive termination.

Disclaimers

The Service is provided "as is" without warranties of any kind. MrFit365 disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

Limitation of Liability

MrFit365 is not liable for indirect, incidental, consequential, or punitive damages arising from the use of the Service. Our aggregate liability is limited to the greater of $100 or the amounts you paid MrFit365 in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes will be resolved in the federal or state courts located in San Francisco County, California.

Changes to Terms

We may update these Terms periodically. Material changes will be communicated via the app or email. Continued use after changes take effect signifies acceptance of the revised Terms.
